EUSTIS, Florida — Eustis Police arrested the man they say shot a man twice last week, and he is back out on the streets after being released on $12,000 bond.
Gary “Pookie” Davis, 42, is accused of shooting the victim once in the right buttock and once in the right calf as the victim retrieved his puppy in the 600 block of Kensington Street Tuesday.
According to a probable cause affidavit, the victim, Davis and another man had been having an ongoing dispute for more than a month. Lake Legal News is not naming the second man because he has not been charged with crime. The unnamed man told EPD the victim came outside yelling about his dog and the man told the victim his dog was not there. The man said the victim then came across the street with a gun and fired several rounds toward the backyard of the house. Police did not find any evidence of shots being fired, according to the affidavit. A witness told police he “hit the ground” when he heard the shots and believed the victim shot himself. Police searched the victim’s home and did not find any firearms.
Another witness told police the victim realized one of his puppies escaped his backyard and he went across the street to look for the dog. The witness said the victim observed Davis hitting the puppy and holding on to its hind legs so it could not escape. The victim took the puppy and as he walked back to his house, Davis opened fire, striking the victim twice. The victim’s girlfriend called 9-1-1 due to extensive bleeding and the victim was airlifted to Central Florida Regional Medical Center in Sanford where he underwent surgery and had one bullet removed; a second bullet remains in his leg.
A warrant was issued for Davis’ arrest Wednesday and he was picked up Saturday afternoon. He was charged with aggravated battery with a deadly weapon and failure to appear on a prior battery charge. He was released Sunday after posting bond.
