Clermont Man Allegedly Tried To Break Child’s Arm Because Child Reached For Slice Of Pizza

CLERMONT, Florida — A man is in the Lake County Jail after being arrested for domestic child abuse Saturday.

According to an arrest affidavit, Brian Lanier King, 43, of Clermont, tried to break a child’s arm when the child attempted to get a slice of pizza; King then slammed the child’s head into a dishwasher and then the floor. The child suffered “several deep scratches,” to both forearms, the booking sheet states. King was “extremely intoxicated” due to drinking several beers throughout the day, the arresting Lake County Sheriff’s deputy noted in the affidavit.

The child’s age and gender were not available and the relationship to King was redacted from the affidavit. King is being held on $10,000 bond

City Of Eustis To Launch Nationwide Search, Following Current Police Chief’s Resignation

EUSTIS, Florida — The Eustis Police chief abruptly resigned Wednesday, citing “other professional opportunities,” according to a press release.

Chief Gary Calhoun tendered his resignation to City Manager Ron Neibert on Wednesday, Neibert told Lake Legal News Wednesday afternoon. The city posted the press release on the city’s Facebook page and the post had garnered 60 comments at press time Thursday. Several comments questioned whether Calhoun resigned on his own accord or was forced out. Neibert denied Calhoun was forced out.

Calhoun was hired in 2015, and while his official last day is Feb. 5, he is taking leave until then, the press release states. Capt. Ken Birkhofer will serve as EPD’s interim chief.

In the coming weeks, the city will determine the criteria it is looking for in the next chief and they will be looking for someone who will, “take the city in the direction it needs to go,” Neibert told LLN. There will be a national search for a new chief, “as soon as reasonably possible,” he said.

The department has seen a tremendous amount of turnover in the last five years. It has 41 sworn officers, 28 of which (68 percent) have left the agency for various reasons — including seven of them who left to go to other law enforcement agencies, Neibert said. There are currently six open positions that still need to be filled.

Salaries may be the reason the department has seen so much turnover, “I’m aware there is some dissatisfaction with the pay,” Neibert said. There have also been some issues with the command structure, he said.

Starting salary at EPD is $40,123, but the neighboring cities of Mount Dora and Tavares starting salaries are $46,180 and $41,808, respectively. According to the United States Census Bureau, in 2019 the population of Mount Dora was 13,897 and the population of Tavares was 16,752. Eustis’ population was 20,700.

State Announces It Will Not Be Able To Prosecute Lake County Armed Meth Trafficking Case

TAVARES, Florida — A man who was found with a cache of drugs in August following a search warrant at his home has been released from the Lake County Jail after all his charges were dropped Tuesday.

Manocher “Manny’ Francis Rafi, 49, was arrested Aug. 27, after Tavares Police searched his home at 909 Maplewood Street and found a safe that had 58 grams of methamphetamine, 28 grams of marijuana, 17 bags of cocaine and a box of ammunition, according to his arrest affidavit last year. Also, in the home, TPD found a loaded pistol, three scales, a pipe and an MDMA pill.

Rafi was facing seven charges from the time of his arrest, including armed trafficking in methamphetamine, possession of cocaine with intent to sell, possession of marijuana with intent to sell, possession of MDMA, possession of a firearm by a convicted felon, possession of a firearm in commission of a felony and possession of drug paraphernalia and was being held on $146,000 bond.

In September, there was an “Announcement of No Information” on his possession of a firearm by a convicted felon charge because he was also charged with armed trafficking, which would be double jeopardy, according to the document. On Tuesday, the remaining six charges were dropped, according to a document filed by the State Attorney’s Office. In the “Nolle Prosequi” document filed by Assistant State Attorney Kristalle Smoller, the document states the charges were dropped due to “arrest/search/investigative issues.”

“There was a technicality with the search warrant,” TPD Lt. Sarah Coursey told LLN Wednesday.

Groveland Man With Child Pornography On Phone Asks FDLE Agent Whether He Can Call Mom, Return To Guatemala

GROVELAND, Florida — A man who asked a Florida Department of Law Enforcement agent if he could “just call his mother and return to Guatemala,” and told him sexual activity with younger females is legal in his country, according to an arrest affidavit, is behind bars and facing one count of possession of child pornography.

Acting on tips about two Facebook profiles from the National Center for Missing and Exploited Children, an FDLE agent went to a home on Rock Springs Circle in Groveland Tuesday to speak with Lorenzo Domingo-Aguilar.

Domingo-Aguilar, 26, admitted to the agent he had shared pornographic videos, but did not remember if there were juveniles in them and said he had not saved any of the files in his phone. Domingo-Aguilar allowed the agent to search his phone and the agent “immediately” found a file depicting a girl, approximately 12 or 13 years old, in a sexually explicit manner, the affidavit states.

Domingo-Aguilar said he did not remember saving the file and the agent stopped looking through his phone until a search warrant could be obtained, according to the affidavit. Domingo-Aguilar was taken into custody and was transported to the Lake County Jail; the FDLE agent requested he be held on no bond due to a statement he made about leaving the country and the potential of additional charges, pending the outcome of the search warrant, according to the affidavit.

Despite the agent’s request, Domingo-Aguilar is being held on $5,000 bond.

Active Sheriff’s Office Investigation Prompted By Shooting In Sorrento Liquor Store Parking Lot

SORRENTO, Florida — The Lake County Sheriff’s Office is releasing very limited information on a shooting that occurred following an argument in a liquor store parking lot Sunday afternoon.

A pair of brothers got into an argument with another male in the parking lot of Country Discount Liquor, 23825 Sorrento Avenue, also known as State Road 46, and the male shot one of the brothers, LCSO Sgt. Fred Jones told Lake Legal News. LCSO responded to the reported shooting at 4:40 p.m. and the man was transported to AdventHealth Waterman in Tavares. The hospital was locked down for a brief time as a precaution, according to a Tavares Police Department Facebook post Sunday.

LCSO is not releasing the names of any of the parties involved, or a motive, as it is still an active investigation, Jones told LLN, and “The victim is not cooperating at this time.”

Suspect Wanted For Halloween Shooting Flees At Sight Of Eustis Detectives In Unmarked Cars — Chase Ensues

EUSTIS, Florida — A suspect wanted in a Halloween shooting rammed two unmarked Eustis Police Department detectives at a local car dealership, fled the scene, was bitten by a K-9 and tased Thursday afternoon, according to Eustis Police Officer J. Allred.

EPD received information that the suspect was going to be at Prestige Ford, 17701 U.S. Highway 441, Mount Dora. Two EPD detectives in unmarked vehicles went to the dealership to take him into custody. He rammed both detectives’ vehicles and fled the scene, Allred told Lake Legal News. Though the detectives were in unmarked units, the suspect did recognize them and knew they were police officers, Allred said.

A Lake County Sheriff’s deputy was in the area and began pursuing the suspect; no EPD officers were involved in the pursuit, Allred told LLN. The man went to the area of State Road 44 and the Eustis Bypass and he bailed on foot near a neighborhood, The Oaks at Summer Glen. As many as five vehicles were damaged around the time of the incident, but officers are still investigating whether all the damaged vehicles are related.

An LCSO K-9 chased after the man and, “The K-9 bit him,” Allred said. He continued to struggle with law enforcement and was tased before being taken into custody. Allred said the man had four felony warrants, but the charges were unavailable at press time Thursday.

Shortly before 1.p.m. Halloween, EPD responded to the area of Cherry Blossom Court after a witness reported a shooting. The victim — who had already fled the scene — told police he was traveling down Country Club Road approaching the stop sign at Washington Avenue when the passenger car behind him went around him and cut him off, EPD Cpl Lauren Brown told LLN in October. The victim honked at the car and a subject got out; the victim put the car in reverse and struck the vehicle behind him; a man got out of that vehicle and there was an altercation between him and the second subject. The victim fled in his red vehicle and multiple vehicles chased him, possibly as many as four, a witness told LLN. The suspects chased the victim and he turned down Cherry Blossom Court attempting to evade them.

The witness said the victim made a U-turn — Cherry Blossom Court is a dead-end — around a tree with a silver car, a black car, a white car and a blue car chasing behind him. All the vehicles made U-turns in neighboring yards and chased the victim back to the entrance. The victim was fired at five times, the witness said. Multiple shots struck the vehicle and the victim got away unharmed.

Hand, Partial Arm, Skulls Recovered in Mount Dora’s Edgewood Cemetery Case — Two Men In Custody

POLK COUNTY, Florida — DNA from a discarded cigar helped a nab a man who robbed several graves of remains last month and when Lake County Sheriff’s Office detectives interviewed him, he confessed and snitched on his partner, according to a press release.

On Dec. 6, a woman and her daughter were driving northbound down Britt Road when they noticed a disrupted tombstone at Edgewood Cemetery and went into the cemetery and found two other graves vandalized and called LCSO, according to a report. Deputies responded and found four graves had been disturbed along with an attempt to access a fifth, LCSO Lt. John Herrell said last month.

“Detectives and crime scene investigators responded to the scene and began the investigation and found evidence that suggests that this incident is very likely tied to some form of ritualistic activity. Detectives also found that there were missing remains from the four graves that had been accessed,” Herrell said.

Crime scene investigators collected evidence, including cigars and a DNA test matched Brian Montalvo Tolentino, 43, of Davenport, in Polk County. Polk County Sheriff’s Office (PCSO) detectives then obtained a search warrant for Tolentino’s DNA on Jan. 6, according to a press release.

LCSO detectives interviewed Tolentino and he confessed to the crime and said Juan Burgos Lopez, 39, of Lake Wales, also in Polk County, was with him. Tolentino told LCSO Lopez used a crowbar to open the vaults and remove the skulls from four graves. Then they returned to Lopez’ home. Tolentino said they stole the skulls for religious practices, the press release states.

PCSO obtained a search warrant Wednesday night for Lopez’ home and found six skulls, a hand, a partial arm and multiple other large bones, within what appeared to be a religious shrine, Herrell said in the press release. Lopez told detectives four of the skulls did come from Edgewood Cemetery and the other two came from “other practitioners.”

Tolentino and Lopez were both arrested for four counts each of disturbing the contents of a grave and abuse of a dead human body. They were both booked into the Polk County Jail on $40,000. Additional charges in Polk County are pending.

Leesburg Police Record Victim’s Controlled Telephone Call To Yalaha Man She Says Sexually Violated Her

LEESBURG, Florida — “Thirty seconds is a long time after someone says stop.”

Those were some of the words a victim spoke to her accused rapist in a recorded phone call last month after telling Leesburg Police the man forced himself on her, according to a probable cause affidavit.

The victim, whose age is unknown, told police she was at a party on Nov. 25 and around 2 a.m. on Nov. 26, Eric Daniel Coffie, 25, said he was going to go pick up food and more drinks, according to a probable cause affidavit. The victim was concerned that Coffie had been drinking and offered to ride with him, she told an LPD detective.

The pair went to a local fast food restaurant and then Coffie drove her to an empty parking lot in Leesburg where he told her he was supposed to meet someone. Coffie began talking to the victim and complimenting her and she laughed it off because she had never “thought about him that way,” she told police. Coffie allegedly touched her thigh and she pushed him away and attempted to get out of the locked vehicle. Coffie, of Yalaha, pulled the victim by her left arm and she fell into the backseat while trying to get away from him, the affidavit states.

Coffie climbed on top of her and held her down, and when she tried to escape, Coffie is alleged to have grabbed the victim’s wrists and held them above her head before pulling her shorts down and raping her. The victim told him no several times and told him to stop, but Coffie kept saying he was almost finished, according to the affidavit.

When he finally stopped, he just stared at her, the victim said and then began to apologize. The victim took out her phone and began to record their conversation. During three separate recordings, the detective heard a male’s voice say, “I said I’m sorry, I really shoulda stopped. I’m sorry I didn’t.” The victim could be heard saying, “You didn’t stop when I kept saying stop.” The male also said, “I was just drunk, just trying to finish, just trying to get my (expletive) and I wasn’t listening.”

After the rape, Coffie drove to a convenience store and bought alcoholic beverages and then went back to the party, the victim told LPD. After returning to the party, the victim went into a bedroom and went to sleep. She did not shower before contacting police and turned her clothing over to an officer, the affidavit states.

The victim called Coffie while police recorded the call that lasted 13 minutes and 37 seconds. The following is an excerpt from that call.   

“Do you realize the amount of times I had to say stop? Like when I said ‘stop’ you kept going. Don’t you think you should have stopped when I said stop,” the victim asked Coffie.

“Yeah,” Coffie said in the recorded call.

“How long did it take you to realize I was serious and was telling you to stop,” she asked.

“I only did a couple of more strokes and then I stopped,” Coffie said.

“Even after I said stop though,” the victim responded.  

“It wasn’t like I was going for a long (expletive) time, it was maybe like 30 seconds, then I stopped,” he said.

“Thirty seconds is a long time after someone says stop,” the victim said.  

Some of the conversation was unintelligible and Coffie attempted to suggest the sex was consensual in the beginning, the detective noted in the affidavit.

A warrant was issued for Coffie’s arrest Monday and he was arrested later that day for sexual battery on a victim over 12. He was released the same day from the Lake County Jail on $25,000 bond.

Leesburg Convenience Store Clerk Sees The Inside Of A Jail After Lottery Audit Uncovers Theft

LEESBURG, Florida — A convenience store clerk was arrested for grand theft and possession of marijuana after she was captured on video stealing lottery tickets, according to an arrest affidavit.

Leesburg Police responded to Circle K, 3300 West Main Street Saturday and a manager told an officer another manager observed an employee handling lottery tickets suspiciously the previous day. After a lottery audit, it was found around 36 scratch-off lottery tickets, valued at $800 were unaccounted for. The complaining manager told police after reviewing surveillance footage, she found that the cashier, Angelique Rose Gayle Williams, 18, took multiple tickets and scanned them, looking for winners.  Williams then cashed in winning tickets for a total of approximately $60 and threw the tickets in the trash.

The video later showed Williams counting the money and putting it in her back pocket, according to the affidavit. When Williams arrived for her shift Saturday, she was arrested and searched and found with a small bag of marijuana. Police asked Williams if she had taken the lottery tickets on other occasions and she refused to answer, but “advised it was not just her,” the affidavit states.

Williams was taken to the Lake County Jail, where she was released on $3,000 bond.

Man Arrested At Colonial Inn, Eustis, On Charges Involving A Meat Cleaver And Fishing Knife

EUSTIS, Florida— A man who apparently did not want another man close to him because of “coronavirus,” was arrested Wednesday for threatening the man with a meat cleaver and a fishing knife.

Just before 8:30 p.m. Eustis Police responded to Colonial Inn, 1000 South Bay Street on a report of an aggravated assault. Lake Legal News has reported on several incidents at the motel since 2019, including two separate search warrants.  When an officer arrived, the victim told him a man he knew as “Junior,” later identified as Rolando Trevino Jr., told him to back up and yelled, “You know coronavirus and (expletive,)” and pulled a chrome meat cleaver with a metal handle from his pants and held it chest high with the blade down, according to the arrest affidavit. Trevino, 28, then allegedly held the cleaver over his own head and said, “If this does not kill, this will,” and pulled a black fishing knife from his pants and also held it chest high with the blade down.

The victim said Trevino did not advance toward him, but he was in fear for his life, so he went back to his room and called the police. Officers found Trevino in downtown Eustis riding a bicycle and holding the meat cleaver. After detaining him, he first told EPD nothing happened and then said he did have a run in with the victim, but never pulled a weapon and told police had he used a weapon, he would have made sure the victim was hurt. Police searched Trevino and found two knives, including the black fishing knife described by the victim.

Trevino was arrested for aggravated assault with a deadly weapon and transported to the Lake County Jail, where he was released Saturday on $2,000 bond.
