Hand, Partial Arm, Skulls Recovered in Mount Dora’s Edgewood Cemetery Case — Two Men In Custody

POLK COUNTY, Florida — DNA from a discarded cigar helped a nab a man who robbed several graves of remains last month and when Lake County Sheriff’s Office detectives interviewed him, he confessed and snitched on his partner, according to a press release.

On Dec. 6, a woman and her daughter were driving northbound down Britt Road when they noticed a disrupted tombstone at Edgewood Cemetery and went into the cemetery and found two other graves vandalized and called LCSO, according to a report. Deputies responded and found four graves had been disturbed along with an attempt to access a fifth, LCSO Lt. John Herrell said last month.

“Detectives and crime scene investigators responded to the scene and began the investigation and found evidence that suggests that this incident is very likely tied to some form of ritualistic activity. Detectives also found that there were missing remains from the four graves that had been accessed,” Herrell said.

Crime scene investigators collected evidence, including cigars and a DNA test matched Brian Montalvo Tolentino, 43, of Davenport, in Polk County. Polk County Sheriff’s Office (PCSO) detectives then obtained a search warrant for Tolentino’s DNA on Jan. 6, according to a press release.

LCSO detectives interviewed Tolentino and he confessed to the crime and said Juan Burgos Lopez, 39, of Lake Wales, also in Polk County, was with him. Tolentino told LCSO Lopez used a crowbar to open the vaults and remove the skulls from four graves. Then they returned to Lopez’ home. Tolentino said they stole the skulls for religious practices, the press release states.

PCSO obtained a search warrant Wednesday night for Lopez’ home and found six skulls, a hand, a partial arm and multiple other large bones, within what appeared to be a religious shrine, Herrell said in the press release. Lopez told detectives four of the skulls did come from Edgewood Cemetery and the other two came from “other practitioners.”

Tolentino and Lopez were both arrested for four counts each of disturbing the contents of a grave and abuse of a dead human body. They were both booked into the Polk County Jail on $40,000. Additional charges in Polk County are pending.

Leesburg Police Record Victim’s Controlled Telephone Call To Yalaha Man She Says Sexually Violated Her

LEESBURG, Florida — “Thirty seconds is a long time after someone says stop.”

Those were some of the words a victim spoke to her accused rapist in a recorded phone call last month after telling Leesburg Police the man forced himself on her, according to a probable cause affidavit.

The victim, whose age is unknown, told police she was at a party on Nov. 25 and around 2 a.m. on Nov. 26, Eric Daniel Coffie, 25, said he was going to go pick up food and more drinks, according to a probable cause affidavit. The victim was concerned that Coffie had been drinking and offered to ride with him, she told an LPD detective.

The pair went to a local fast food restaurant and then Coffie drove her to an empty parking lot in Leesburg where he told her he was supposed to meet someone. Coffie began talking to the victim and complimenting her and she laughed it off because she had never “thought about him that way,” she told police. Coffie allegedly touched her thigh and she pushed him away and attempted to get out of the locked vehicle. Coffie, of Yalaha, pulled the victim by her left arm and she fell into the backseat while trying to get away from him, the affidavit states.

Coffie climbed on top of her and held her down, and when she tried to escape, Coffie is alleged to have grabbed the victim’s wrists and held them above her head before pulling her shorts down and raping her. The victim told him no several times and told him to stop, but Coffie kept saying he was almost finished, according to the affidavit.

When he finally stopped, he just stared at her, the victim said and then began to apologize. The victim took out her phone and began to record their conversation. During three separate recordings, the detective heard a male’s voice say, “I said I’m sorry, I really shoulda stopped. I’m sorry I didn’t.” The victim could be heard saying, “You didn’t stop when I kept saying stop.” The male also said, “I was just drunk, just trying to finish, just trying to get my (expletive) and I wasn’t listening.”

After the rape, Coffie drove to a convenience store and bought alcoholic beverages and then went back to the party, the victim told LPD. After returning to the party, the victim went into a bedroom and went to sleep. She did not shower before contacting police and turned her clothing over to an officer, the affidavit states.

The victim called Coffie while police recorded the call that lasted 13 minutes and 37 seconds. The following is an excerpt from that call.   

“Do you realize the amount of times I had to say stop? Like when I said ‘stop’ you kept going. Don’t you think you should have stopped when I said stop,” the victim asked Coffie.

“Yeah,” Coffie said in the recorded call.

“How long did it take you to realize I was serious and was telling you to stop,” she asked.

“I only did a couple of more strokes and then I stopped,” Coffie said.

“Even after I said stop though,” the victim responded.  

“It wasn’t like I was going for a long (expletive) time, it was maybe like 30 seconds, then I stopped,” he said.

“Thirty seconds is a long time after someone says stop,” the victim said.  

Some of the conversation was unintelligible and Coffie attempted to suggest the sex was consensual in the beginning, the detective noted in the affidavit.

A warrant was issued for Coffie’s arrest Monday and he was arrested later that day for sexual battery on a victim over 12. He was released the same day from the Lake County Jail on $25,000 bond.

Leesburg Convenience Store Clerk Sees The Inside Of A Jail After Lottery Audit Uncovers Theft

LEESBURG, Florida — A convenience store clerk was arrested for grand theft and possession of marijuana after she was captured on video stealing lottery tickets, according to an arrest affidavit.

Leesburg Police responded to Circle K, 3300 West Main Street Saturday and a manager told an officer another manager observed an employee handling lottery tickets suspiciously the previous day. After a lottery audit, it was found around 36 scratch-off lottery tickets, valued at $800 were unaccounted for. The complaining manager told police after reviewing surveillance footage, she found that the cashier, Angelique Rose Gayle Williams, 18, took multiple tickets and scanned them, looking for winners.  Williams then cashed in winning tickets for a total of approximately $60 and threw the tickets in the trash.

The video later showed Williams counting the money and putting it in her back pocket, according to the affidavit. When Williams arrived for her shift Saturday, she was arrested and searched and found with a small bag of marijuana. Police asked Williams if she had taken the lottery tickets on other occasions and she refused to answer, but “advised it was not just her,” the affidavit states.

Williams was taken to the Lake County Jail, where she was released on $3,000 bond.

Man Arrested At Colonial Inn, Eustis, On Charges Involving A Meat Cleaver And Fishing Knife

EUSTIS, Florida— A man who apparently did not want another man close to him because of “coronavirus,” was arrested Wednesday for threatening the man with a meat cleaver and a fishing knife.

Just before 8:30 p.m. Eustis Police responded to Colonial Inn, 1000 South Bay Street on a report of an aggravated assault. Lake Legal News has reported on several incidents at the motel since 2019, including two separate search warrants.  When an officer arrived, the victim told him a man he knew as “Junior,” later identified as Rolando Trevino Jr., told him to back up and yelled, “You know coronavirus and (expletive,)” and pulled a chrome meat cleaver with a metal handle from his pants and held it chest high with the blade down, according to the arrest affidavit. Trevino, 28, then allegedly held the cleaver over his own head and said, “If this does not kill, this will,” and pulled a black fishing knife from his pants and also held it chest high with the blade down.

The victim said Trevino did not advance toward him, but he was in fear for his life, so he went back to his room and called the police. Officers found Trevino in downtown Eustis riding a bicycle and holding the meat cleaver. After detaining him, he first told EPD nothing happened and then said he did have a run in with the victim, but never pulled a weapon and told police had he used a weapon, he would have made sure the victim was hurt. Police searched Trevino and found two knives, including the black fishing knife described by the victim.

Trevino was arrested for aggravated assault with a deadly weapon and transported to the Lake County Jail, where he was released Saturday on $2,000 bond.

Eustis High School Parents Learn Of Student’s Arrest — Self-Proclaimed ‘Folk Nation Gangsta Disciple’ Had Gun At School

EUSTIS, Florida— On the first day back from holiday break, a 16-year-old Eustis High School student was arrested for having a loaded gun on campus Monday.

Jaiden Dylan Vickers, 16, is facing serious charges after pills and a loaded 9mm Kel-Tec handgun was found in his backpack that he left in a classroom during basketball practice, according to an arrest affidavit.  Three pills were also found in a pill bottle in the backpack and the label on the bottle did not match Vickers’ name. One pill was an allergy medication, one was Ritalin and the third was Zolpidem, the affidavit states.

Vickers, a self-identified gang member, told the school resource deputy (SRD) he belongs to “Folk Nation, Gangsta Disciples” and denied knowledge of the gun. The SRD spoke to Vickers’ father and he said the boy posted a photo of himself holding a gun on Instagram and had his phone taken away as punishment, according to the affidavit.  

Vickers then changed his story and said he used a rope with a magnet to retrieve the gun from Lake Eustis after one of his friends fired it, and it fell in the lake. Vickers was arrested for possession of a firearm on school grounds and two counts of possession of a controlled substance without a prescription. He was transported to the Lake County Jail and turned over to the Department of Juvenile Justice.

A recorded message went out to parents of Eustis High School students late Monday afternoon, informing them a gun was found in a backpack on the main campus. “No one was threatened or injured, however bringing a weapon to school is a violation of our code of student conduct,” the message stated in part.

Eustis Man Allegedly Invites Juvenile Runaways To His House To Smoke Pot — Sex Investigation Ongoing

EUSTIS, Florida — A Eustis man who was armed with two knives and a firearm when police found him with two juvenile females— one of whom was overdosing— has been released on $7,000 bond after being arrested for contributing to the delinquency of a minor and felony child abuse on Wednesday.

An officer with Eustis Police Department was conducting a property check early Wednesday morning at Woodland Center, 1950 North State Road 19, when he found a 16-year-old girl sitting on a bench at the plaza. The girl told EPD she ran away from a local group home, along with two other 16-year-old girls, and they walked to a gas station where they met Joel Rivera, 39, according to an arrest affidavit.

Rivera invited the trio of girls to his house and they walked to the house, which EPD later found on Frosti Way. The girl told police the other two girls were at Rivera’s house and one of them may be overdosing on cold medicine. The girl was unable to tell officers where Rivera’s house was located, but did show them, the affidavit states.

EPD arrived at Rivera’s home and Rivera allowed them to look for the two girls. Officers went into a bedroom and found one girl on the floor and one sitting on the bed. One of the girls “appeared dazed and confused and (redacted) was unable to answer simple questions,” the affidavit states. Due to heavy redaction in the affidavit, it is unclear if the officer was referring to the girl on the bed, or the girl on the floor.

Police detained Rivera and found two knives and a loaded firearm in his pocket; Rivera claimed he grabbed the gun when officers knocked on the door because he did not know who was at the door, the affidavit states. Police rendered aid to the girl who appeared to be overdosing and the second girl fled but was quickly apprehended. She told police the first girl took eight cold pills before the trio met Rivera at a nearby gas station. Rivera invited the girls back to his house to “hang out” and smoke marijuana and the group walked to Rivera’s house, where they smoked “a lot” of marijuana, one of the girls said.

One of the girls, whose name is also redacted, told officers Rivera touched her hips and began to kiss her and she was “too high” to say anything. She said Rivera had sex with her and that it was the first time she ever had sexual intercourse.

Rivera was questioned and he told police the girls told him they were 18, 19 and 20 and he did invite them to his house; once there one of the girls started acting strange and he called a friend and said he thought she might be overdosing. The unknown friend told Rivera to “watch” her and call 9-1-1 if her condition worsened. Rivera told police he approached one of the girls and began to “make out with her but nothing more.”

Rivera was arrested for felony child abuse and contributing to the delinquency of a minor. Rivera’s clothing and the victim’s clothing were collected and submitted into evidence, according to the booking sheet.

 Lake Legal News asked EPD why Rivera was not charged with a sex crime. “The investigation is ongoing,” said EPD Cpl. Lauren Brown.

Pregnant Woman Suffers Two Violent Attacks By Boyfriend In Howey — Crawls To Get Away

HOWEY-IN-THE-HILLS, Florida — A pregnant woman who had to crawl through a patch of woods to get away from her violent boyfriend told Howey-in-the Hills Police the man said he was going to “punch her in the stomach to get rid of her problem,” last week.

The woman told police Steven Wallie Matthews, 36, came home on Oct. 4 between 11 p.m. and midnight and woke her up, screaming and yelling in her face; she said she believed he was angry about her pregnancy, according to an arrest affidavit. Matthews head-butted the victim in the face, giving her a bloody nose. The victim fled the violent scene and went to the police department, but no one was at the office and she did not have her phone because Matthews had taken it, the affidavit states.

She returned home and found Matthews was not there and she went to sleep. On Oct. 5, Matthews woke her again by yelling and screaming. The victim grabbed her clothes and went into another room to change and Matthews is alleged to have chased her down, slammed her against a door several times and slapped her in the face. She found her phone and tried to leave, but Matthews chased her again and said, “he was going to punch her in the stomach to get rid of her problem,” the affidavit states. Matthews then took her phone again.

The victim crawled through a patch of woods to get away from Matthews and a neighbor called the police department’s non-emergency number and no one answered. She then went to a convenience store on Palm Avenue and called for help.

Police arrived and found the victim with visible injuries and dried blood on her clothes and face, the arresting officer noted in the affidavit. Police contacted Matthews and placed him under arrest for aggravated battery on a pregnant female and deprivation of 9-1-1.

Matthews’ bond was revoked on a possession of methamphetamine charge from August 2020. He is being held at the Lake County Jail on no bond.

Home Invasion Investigation Underway In Eustis

EUSTIS, Florida — A home invasion Monday night is under investigation, according to Eustis Police Officer J. Allred.

EPD responded to a complaint of multiple gunshots in the area of Tall Pines Villas, 1000 Wall Street around 11:30 p.m. Monday. Officers were flagged down in the area of Pine Avenue, according to a press release. The victims told police two black males, over 6 feet tall and weighing more than 200 pounds entered their home and demanded a female victim come with them.

The suspects escorted her outside, but then allowed her to return to the home, Allred said. They were both wearing black hoodies and black neck gaiters; one is described as light-skinned with a bald head, and the second man had darker skin. Both men have a muscular build, the victim told police.

Mount Dora Traffic Fatality: Wife And Children Open Up About Losing A Man Who Was “Just Amazing”

EUSTIS, Florida — Seventeen years ago Adrick Rojas pushed his best friend’s sister down on a bed and kissed her. And there began a love story spanning nearly two decades that included the couple moving to Lake County and bringing four children into this world who are loved dearly.

“Our first kiss! We were sitting in my brother’s room and my brother walked out for whatever reason. Adrick pushed me down on the bed and kissed me! Then [he] looked at me and yelled, ‘You kissed me!”

“I didn’t kiss you! You kissed me!”

“I definitely didn’t kiss you! You pinned me down! I’m telling your brother!”

“And then he kissed me again.”

Rojas’ wife Shannon, spoke with this reporter Monday, about her husband, just six weeks and one day after he passed away in a tragic crash and spoke about their children and their life together, including the kiss that started it all.

Growing up in South Florida, Rojas, 36, was Shannon’s brother’s best friend and the two sets of parents were best friends as well, Shannon said. Shannon’s grandparents were looking to move to The Villages and instead found 12.5 acres in Eustis. In 2004, when Shannon and Adrick’s oldest daughter, Mikaylee was just two months old, they moved to Lake County and began their new life together. The family property is like a compound, Shannon laughed; her grandparents gave her brother and parents three acres each, along with Shannon and Adrick.  

Adrick, who learned his gardening skills from his mom, grew tomatoes, strawberries and peppers also built Shannon a garden and koi pond. “He built me a special garden where I park,” she said.

Shannon’s strength was apparent as she spoke with this reporter; although she choked back tears several times during the interview, she also acknowledged Adrick made a mistake the evening of Aug. 16.

“He was irresponsible in his speed, 100 percent. I cannot defend him on that,” she said, “but he was so much more than that. That one mistake is not what makes you.”

According to a report released by Mount Dora Spokeswoman Lisa McDonald, witnesses told Mount Dora Police Adrick was driving southbound around 80 miles per hour, near 4150 Highway 19A in a 2001 black Ford Expedition around 6:45 p.m. when he attempted to pass another driver. He crossed over the double line, lost control and rolled the SUV three times and was ejected. He was killed less than a block from his job, Simplex, Inc. a glass and mirror business, located at 4085 North Highway 19A.  

Adrick, who worked in construction most of his life picked up his skills from both of his dads and could do it all, Shannon said. “[He could do] anything you could think of in construction.”

Adrick was an avid skateboarder for many years. Everywhere the family went the skateboard was in the trunk, Shannon remembers fondly. “He had our babies on a skateboard.”

The couple has four children, and they all miss their father desperately. Shannon said he was a very active father and they referred to him as their “bearded Disney Daddy.” The children shared some of their tender memories.

“Dad was my gossip buddy. He would hear about everything I had to say. Even at 6:30 every morning when he drove me to school. I miss you Dad,” said Mikaylee, 15.

Maddox, 12, the couple’s only son, has stepped up as the ‘man of the house,’ Shannon said. He misses his father terribly. “He really liked playing sports with me. I miss you a lot, Dad.”

Maylani, 6, who would wait at the door with her little sister Mila and the family’s two dogs for their Daddy to come home every day so they could ride on his back like a horse, misses their tea parties. “He would play dress up with us and let us put pretty bows in his hair and beard! I love you so much, Daddy! My Daddy was the best Daddy in the world!”

Three-year-old Mila waves to her Daddy in the sky each day, Shannon told LLN. “My Daddy dance with me! Daddy’s in the sky! I love my Dad.”

Shannon and her children struggle with the loss each day, “The only thing keeping me going is those four babies,” but next month will be especially hard. The couple shares the same birthday — Oct. 17. This will be the first birthday in 17 years they spent apart, Shannon (one year older than Adrick) told LLN with a laugh; she was always known as the cougar because she is one year older.

Though Shannon spoke of many things she loved about Adrick, she said it was his smile that always got to her. It was infectious, he lit up a room and was the life of the party. “His smile. Everything about his smile.”

Shannon visits Adrick’s grave each Sunday and cleans up and brings fresh flowers; a plaque at the gravesite reads, “If I had my life to do over again… I’d find you sooner so I could love you longer.”

 “I want him remembered as an amazing friend and a great father. He was just amazing.”

Mount Dora Man Arrested On DUI Manslaughter Charges, Regarding 2019 Christmas Eve Crash That Killed Eustis Family

LEESBURG, Florida — A drunk man who killed three members of the same family in a tragic Christmas Eve crash was more than double Florida’s legal limit, had amphetamines and benzos in his system and was driving nearly 50 mph over the posted speed limit, according to a crash report released by Leesburg Police Department Thursday.

Zachery Maurice Waldo, 34, of Mount Dora is facing a slew of charges stemming from the night of the crash and he added two more charges after striking a Lake County Sheriff’s deputy’s car and fleeing from law enforcement before his capture Wednesday night.  

On Christmas Eve 2019, Waldo was driving a 2019 Dodge Ram around 8:30 p.m. eastbound on Dixie Avenue approaching Dozier Court, when a 2018 Toyota Corolla being driven by Christopher Smith attempted to make a left turn on Dozier Court from westbound Dixie Avenue, said Leesburg Police Capt. Joe Iozzi last year.

The event data recorder (EDR) for the Ram recorded the Ram’s speed at 84.5 mph one tenth of a second from the time of impact, but just 2 seconds before the Ram was traveling at 96.3 mph, according to the report. The posted speed limit is 35 mph, and a witness told LPD the Ram did not slow down, and the brake lights did not illuminate. A witness also put Waldo behind the wheel just the crash and DNA confirmed, Iozzi told Lake Legal News.

The front of the Ram struck right side of the Toyota, killing Smith, 44, and his wife, Jessica Smith, 35, both of Eustis. They were pronounced dead on the scene. The couple’s two children,11-year-old Hunter and 13-year-old Hailey, who were passengers in the Toyota, were taken to Orlando Health Arnold Palmer Hospital for Children for treatment. Hailey succumbed to her injuries and died on Christmas Day.

Waldo and his passenger, Kevin Cunningham, 33, were taken to Ocala Regional Medical Center for their injuries. LPD obtained hospital records and Waldo was found to have an alcohol level twice the legal limit, along with amphetamines and benzos in his system, according to the report.

Upon searching the Ram, LPD found a loaded Ruger .40 caliber handgun stolen from Mount Dora, six sandwich bags containing 157.8 grams of marijuana and six cell phones, according to the report.  

LPD obtained a warrant for Waldo’s arrest earlier this month and had been looking for him in the Leesburg area, Iozzi said. “He was pretty transient.”

On Wednesday night, LCSO deputies and the U.S. Marshals Service (USMS) were performing surveillance and spied Waldo get into a black Dodge SUV. Waldo drove out of a neighborhood on Chain O Lakes Road and rolled a stop sign at County Road 44, according to an arrest affidavit. An LCSO deputy attempted a traffic stop and Waldo sped off, running other vehicles off the road. Multiple USMS and LCSO units attempted to stop Waldo and he struck an LCSO patrol car and crashed through a fence on Tall Oak Court, the affidavit states.

Waldo fled on foot and hid in the bushes of a home on Grand Island Oaks Circle and asked for a ride from a man returning home from work. The man denied him the ride and Waldo took off again and jumped over a fence to Laurel Crest Court. He was found lying on the ground wearing nothing but underwear, the affidavit states.  

Waldo was taken into custody and transported to the Lake County Jail. He is charged with three counts of DUI manslaughter, DUI with serious injury, possession of a firearm by a convicted felon, possession of marijuana with intent to sell, possession of paraphernalia, fleeing and eluding and aggravated battery on a law enforcement officer.

He is being held in the LCJ on $148,000 bond. “I think it’s a pretty solid case,” Iozzi told LLN Thursday.
